<p>It is the responsibility of the <strong>Indemnitor/Cosigner</strong> to see that the premium is paid and the defendant appears in court. The Indemnitor must bring the defendant into our offices within 24 hours of their release for an interview, instructions and to complete the paperwork.</p>
<p>A bail bond is an appearance bond and is good for one year. If the case continues longer than a year, an additional premium is due and is collected for each additional year.<strong>THESE PREMIUMS ARE NOT REFUNDABLE</strong>. Any expenses incurred in the transaction of a bail bond are to be paid by the indemnitor to the bail agent. This is regulated by the State of Washington and are the same for every Bail Bond company.</p>
<p>If the defendant or Indemnitor changes addresses, phone numbers or employment, it is the responsibility of the <strong>Indemnitor</strong> to notify us within 48 hours.</p>
<p><strong>IF THE DEFENDANT DOES NOT APPEAR</strong></p>
<p>The defendant is obligated by the bail agreement to appear at each court appearance required by the court. The failure to do so will result in the <strong>FORFEITURE OF THE BOND</strong>.  As an indemnitor, you would be required to <strong>IMMEDIATELY</strong> bring the defendant in to either reinstate the bond or surrender them back into custody.</p>
<p>In case of a <strong>FORFEITURE and SUMMARY JUDGMENT</strong>, it is the duty of the<strong>INDEMNITOR</strong> to pay the full amount of the bail. Failure to act immediately can add up court costs and expenses/fees if legal action is taken. The law provides that the associated expenses can not exceed the face amount of the bond.</p>
<p><strong>GETTING OFF THE BOND LIABILITY</strong></p>
<p>You are no longer liable for the defendant's bond when they have completed all of their court appearances, and when all premiums and expenses have been paid. In the event of <strong>FORFEITURE</strong>, the indemnitor is liable until the full penal amount of the bail has been paid or the defendant properly appears in court. The bond will then be exonerated and you will no longer be liable.</p>

<p>First and foremost is to appear at <span style="text-decoration: underline;">all required court dates and times</span>. This burden is on you. No matter what happens, even if someone else makes a mistake,<span style="text-decoration: underline;"> it is </span><strong><span style="text-decoration: underline;">your</span></strong><span style="text-decoration: underline;"> responsibility to make all appearances</span>.</p>
<p>We and/or the Indemnitor (whoever paid your bond), can and will impose additional restrictions on your freedoms. Depending on the severity of the charges these can range from being under house restriction, not traveling out of the county, drug/alcohol/psychological treatment programs, or maybe just checking in with our office periodically.</p>
<p>If you don't meet at the jail, you are required to meet with one of our agents for an in-person interview and to complete the paperwork within 24 hours of being released. At this time we will explain the conditions of your release so you will have no surprises. We will also provide you with the date and time of your first court appearance. We are here to make the process as easy for you as possible and will try to help any way we can.</p>
<p>The important thing to remember is that the Bondsman and your Indemnitors have complete control over your person until your case is completed. If you fail to comply with <strong>any</strong> of the conditions of your release or <strong>any of the parties</strong> believe you are going to violate a condition of the bond or become a flight risk, <strong>you will be arrested and placed back into custody</strong>. We have some of the best Fugitive Recovery Agents in the business and failure to appear on a bond is a crime.  It can carry its own charge against you.</p>
<p>In summary, your task is to deal with the justice system and any problems that may arise. We are here to help you do this, you aren't alone. Your situation can <strong>only become worse</strong> if you don't deal with all the requirements of the justice system.</p>

<p>SEATTLE — Washington voters overwhelmingly decided Tuesday to give judges more power to deny a suspect bail, after last year's brutal slaying of four Lakewood police officers by a gunman who had recently been released.</p>
<p>The Legislature approved the measure in the spring, but it was a constitutional amendment and needed voter approval to be enacted. It was passing with about 86 percent of the vote.</p>
<p>Previously, the only charge for which bail could be denied was aggravated murder. The amendment allows state judges to deny bail when a suspect is charged with any crime carrying a possible life sentence and poses a danger to the community. About 4,100 defendants a year are charged with such crimes in the state.</p>
<p>"It is a new tool prosecutors and judges can use to keep the baddest of the bad off the streets," said Reagan Dunn, executive director of the Remember Lakewood campaign. "This was a measured, common sense referendum to the people. It doesn't violate defendants' rights and it seems sensible to most people."</p>
<p>Maurice Clemmons had posted bail less than a week before he killed the four Lakewood officers last November. He had been arrested for investigation of child rape, which could have brought a life sentence because of his previous criminal record.</p>
<p>Among the measure's supporters was Kim Renninger, the widow of Lakewood Sgt. Mark Renninger, who says it could save someone's life.</p>
<p>Renninger and officers Tina Griswold, Ronald Owens and Greg Richards were ambushed at a coffee shop in a Tacoma suburb on Nov. 29. Clemmons eluded police for two days, but was shot and killed by an officer in Seattle after a massive manhunt.</p>
<p>Opponents of the measure argued that judges could already set high bail or other conditions of release. The problem in Clemmons' case wasn't that the judge who granted the release had too little authority, but too little information about the defendant's extremely violent past, they said.</p>
<p>At least a dozen other states, including California and Florida, have constitutional clauses or statutes that allow judges to deny bail for charges other than capital crimes, according to the National Conference of State Legislatures.</p>
<hr /><strong>WA task force makes bail system recommendations </strong>- Posted December 5, 2010</p>
<p>Seattle Times ~ OLYMPIA, Wash. (AP) - A Washington state task force formed after the shooting deaths of four police officers recommended on Wednesday tighter regulation of bail bondsmen and more information-sharing with judges who set bail.</p>
<p>The suspect in the police deaths, Maurice Clemmons, bailed out of jail three times in 2009 without ever paying more than 4 percent up front, including just days before the Lakewood police shootings, the Seattle Times reported.</p>
<p>Unlike some states, Washington does not require people getting a bail bond to pay 10 percent of its value.</p>
<p>The 20-person task force, which was created to study the bail system following the police deaths, did not suggest minimum payment rates for those who get a bail bond.</p>
<p>Judges, prosecutors and victims' advocates have argued for a fixed bail bond premium. But defense attorneys and others have worried that a minimum payment could hurt the poor, the Times reported.</p>
<p>Task force member and Snohomish County prosecutor Mark Roe said some officials were "disillusioned" they didn't know bail bondsmen required less than 10 percent.</p>
<p>"To be honest, I was embarrassed," Roe told the Times.</p>
<p>But the task force's chairman, state Sen. Adam Kline, D-Seattle, said the Clemmons case was an extreme example that shouldn't set policy. He also said a fixed premium could hurt poorer people charged with crimes.</p>
<p>"As a practical matter, the standard is 10 percent in almost every case," Kline said.</p>
<p>Sen. Mike Carrell, R-Lakewood, said he favors a minimum payment for bail bonds. Without it, bail bondsmen are effectively setting bail instead of judges, Carrell said.</p>
<p>"If judges can't have some certainty, then how can they ever set bail to ensure community protection?" Carrell asked.</p>
<p>The task force's report recommended that the 2011 Legislature come up with "a generally recognized definition of what bail means, subject to further discussion."</p>
<p>It also suggested giving judges more information about people seeking bail, such as risk-prediction tools from the Department of Corrections and mental health records. Bondsmen should also be required to go through background checks and county court systems, which verify bail-bonding companies, could be required to tell each other whether bail-bond companies are on shaky financial footing.</p>
<p>Voters in November approved a state constitutional amendment, also spurred by the Clemmons case, that grants judges broader authority to deny bail.</p>

<p>(Reuters) - Authorities are investigating a buried explosives and weapons cache that may be linked to a Cuban drug-dealer informant killed by bounty hunters in a shootout two years ago near Tacoma, Washington.</p>
<p>The stockpile included a 37-millimeter military shell, a stick of 50-caliber dynamite, four improvised explosives, a commercial-grade blasting cap, guns and two belts of military-grade ammunition, Bureau of Alcohol, Tobacco, Firearms and Explosives spokeswoman Cheryl Bishop said on Saturday.</p>
<p>Law enforcement officials unearthed the cache -- buried four feet deep on private land in Puyallup, a suburban town located five miles east of Tacoma - and safely detonated the military shell late on Friday, said Captain Scott Engle, a Puyallap Police Department spokesman.</p>
<p>The property's current owners were not linked to the find or in any criminal investigation.</p>
<p>ATF, Puyallup police, and Pierce County sheriff's, bomb squad and fire officials, who acted on a tip in "another criminal case," secured the cache, Engle said.</p>
<p>Although federal authorities and local law enforcement don't anticipate filing criminal charges in the "unusual" discovery, Engle added: "We are going to do some follow-up."</p>
<p>ATF investigators believe the cache was linked to a dead man, killed two years ago in the nearby town of Lakewood, Bishop said, adding that she was "unable" to provide additional specifics or a name.</p>
<p>The incident matches local media and police reports of a killing involving Robert Pupo Roque, 34, a Cuban immigrant, alleged drug dealer and informant killed in the shoot-out by two Liberty Bail Bonds bounty hunters in May 2008.</p>
<p>Forrest Marshall, owner of Liberty Bail Bonds of Kelso, Washington, told Reuters his employees shot Roque in "self-defense" while attempting to collect $150,000 in outstanding bail bonds when Roque failed to show up in court.</p>
<p>Roque had been charged with drug dealing and unlawful gun possession. The Liberty bounty hunters later were cleared in the shooting by Pierce County prosecutors, Marshall said.</p>
<p>Roque was a police informant who "told the Tacoma police department in front of me and a partner that he had a guided missile, a practice missile that had been stolen from Fort Lewis," Marshall said.</p>
<p>Roque was said "on the street" to be involved with Mexican drug-dealers, Marshall added.</p>
<p>Fort Lewis, an Army base, is now part of Army-Air Force Joint Base Lewis-McChord near Tacoma following a merger in February 2010.</p>

<p><strong>Q:</strong> How do Bail Bonds Work?</p>
<p><strong>A:</strong> Bail is used to release a defendant for money. The money is used as an assurance that the defendant will make it to their court dates. Since some trials can take a long time, the Bail Bonds System permits a possibly innocent defendant from waiting for their court date in a jail.</p>
<p><strong>Q: </strong>What is the Bail Process?</p>
<p><strong>A:</strong> When arrested, people are usually moved to a law enforcement building where they are "booked". This involves documenting the crime that allegedly has happened and personal information about the suspect. During booking, they will take a photo and fingerprint the suspect. They run a background check on the suspect and hold any of the suspect’s personal property which is returned to the suspect when released. The officers usually will allow the suspect to make a phone call. After booking, the suspect is incarcerated in a county jail or a pol;ice station facility. With crimes not deemed serious, the suspect can usually post bail immediately. In cases of more serious crimes, the suspects will have to wait for a bail hearing. At the hearing, a judge will decide if the suspect may be released on bail and the amount.</p>
<p>Bail is based on the suspect’s flight chance and the crime accused. A criminal history, or having not shown up for court appearances may affect a judge’s decision about the bail amount. A judge will also consider if they believe the suspect to be a risk to others, work history and the nature of the crime.  Bail is at the judge’s discretion, although some counties will have bail schedules, which sets a standard bail for certain crimes.</p>
<p><strong>Q:</strong> If arrested, what are the available release options?</p>
<p><strong>A:</strong> There are five release options available: cash bond, surety bond, property bond, own recognizance (O.R.), and citation release.</p>
<p><span style="text-decoration: underline;">Cash Bond</span>: To be released on cash bail, someone must post with the court the total amount of the bail, in cash. The purpose of this is to secure his or her return to court on an appointed date, and thereafter until the case is concluded. If the defendant shows up for his/her scheduled court appearances, the cash is returned to him/her, minus any court fees and fines. If s/he fails to appear, the cash bond is forfeited to the court.</p>
<p><span style="text-decoration: underline;">Surety Bond</span>: An alternative to cash bail is the posting of a surety bond (Bail Bond). This process involves a contractual undertaking guaranteed by an admitted insurance company having adequate assets to satisfy the face value of the bond. The bail agent guarantees to the court that they will pay the bond forfeiture if a defendant fails to appear for their scheduled court appearances. The bail agent’s guarantee is made through a surety company and/or by the pledge of property owned by the agent.</p>
<p><span style="text-decoration: underline;">Property Bond</span>: In rare cases an individual may obtain release from custody by means of posting a property bond with the court. Here the court records a lien on property, to secure the bail amount. If the arrestee subsequently fails to appear at the scheduled court date, the court may institute foreclosure proceedings against the property to obtain the forfeited bail amount.</p>
<p><span style="text-decoration: underline;">Own Recognizance (O.R.)</span>: Another method of release pending trial is through a county or law enforcement administered pre-trial release program. Usually, the staff members of these programs interview individuals in custody and make recommendations to the court regarding release of these individuals on their own recognizance (i.e., without any financial security to insure the interviewee's return).</p>
<p><span style="text-decoration: underline;">Citation Release</span>: This procedure, known as the "Cite Out", involves the issuance of a citation by the arresting officer to the arrestee, informing the arrestee that he or she must appear at an appointed court date. The Cite Out usually occurs immediately after an individual is arrested. Such an arrestee’s appearance in court depends exclusively upon the integrity of the arrestee and his or her voluntarily returning to court.</p>
<p><strong>Q:</strong> How do you Post Bond?</p>
<p><strong>A:</strong> Once the amount of the bond is decided, the suspect usually can be released if they post the bond in cash or assets. If the accused person does not have the money or the assets to pay for bond, they can apply to a Bail Bondsman like A Plus Bail Bonds.  The bondsman will take 10% of the bond amount and will supply the rest of the money so that the suspect can leave jail. The 10% fee amount is the same for all Bond Companies in Washington State and is set by the State Government.</p>
